How we process the personal data of applicants for CMS Kluge’s Start-up Help
 
When you use our website to submit an application for CMS Kluge’s Start-up Help, CMS Kluge Advokatfirma AS processes personal data about you. Why we collect personal data and what information we collect

We collect and use your personal data to assess your application for CMS Kluge’s Start-up Help. Here is a list of the personal data we collect for the following purposes:

  • To identify you and/or your organisation and to gain an overall view of your and/or your organisation’s business-law needs: name, job title, organisation name, organisation address, website, ownership details and competitors. This information allows the Board to decide which applicants should be granted CMS Kluge’s Start-up Help. The processing of personal data is based on a balance of interests, cf. point f of Article 6(1) of GDPR. We consider this to be necessary in order for us to select suitable organisations and provide legal assistance to you in an effective manner, and that therefore the processing is in both our interest and yours, and that the processing is minimally intrusive to you.

  • To answer enquiries that we receive: name, telephone number, e-mail address and any other personal data that may pertain to the enquiry. The processing of personal data is based on a balance of interests, cf. point f of Article 6(1) of GDPR. We consider this to be necessary in order for us to provide legal assistance to you in an effective manner, and that therefore the processing is in your interest and is minimally intrusive to you.

  • We store your name and contact information in order to maintain a historical overview of awards of CMS Kluge’s Start-up Help and to enable us to contact you again at a later date to offer you breakfast seminars, newsletters, etc. The processing of personal data is based on a balance of interests, cf. point f of Article 6(1) of the GDPR. We consider that our interest in seeing the results of the awards of CMS Kluge’s Start-up Help is a legitimate interest that in a balance of interests gives a lawful basis to store your personal data.

Disclosure of personal data to others

As part of our processing of your application for CMS Kluge’s Start-up Help, in some cases we may provide your personal data to our partner Håmsø Patentbyrå AS. The reason for this is that being granted CMS Kluge’s Start-up Help also qualifies you for start-up help from Håmsø Patentbyrå AS within the field of intellectual property law. The disclosure takes place on the basis of a balance of interests, cf. point f of Article 6(1) of the GDPR. We consider that such disclosure of registered information to Håmsø Patentbyrå AS may be necessary in order to provide appropriate legal assistance to you, and that the disclosure is therefore in your interest and minimally intrusive to you.

We will not disclose your personal data to others unless there is a legal basis for such disclosure. Examples of such a basis will typically be an agreement with you or a legal requirement that instructs us to pass on the information.

All of our processing of personal data takes place within the EU/EEA.
 
Storage period

We store your personal data for as long as is necessary for the purpose of collection. All applications from candidates who are not granted CMS Kluge’s Start-up Help will be deleted once the award decision is made and all associated case handling is completed. The personal data of applicants who have been granted CMS Kluge’s Start-up Help will be stored for as long as is necessary in order to complete the application process and establish a lasting and official client relationship.

No form of automated decision-making takes place in connection with the processing of applications for CMS Kluge’s Start-up Help.

You have the right to withdraw your consent for CMS Kluge’s processing of your personal data at any time.

 
Your rights concerning our processing of your personal data

You have the right to request access to, rectification or erasure of the personal data we process about you. Furthermore, you also have the right to restrict processing, to object to processing and to claim the right of data portability. We will ask you to confirm your identity or provide additional information before we allow you to exercise your rights in relation to us. We do this to ensure that only you are given access to your personal data, and not someone passing themselves off as you.

Complaints

If you believe that our processing of personal data does not match what we have described here or otherwise violates data protection legislation, we would appreciate you contacting us as soon as possible. We will try to act on your comments as well as possible, and to the extent that we believe is reasonable based on the appropriate legislation.
